justice Vs.Delay
I share with people who have genuine grievance about delay in justice delivery system. Victims and their kit and keens have desire that the cases should end in time and that too in their favour.Nothing wrong in that. The opposite party has just reverse interest and desires that the case be delayed
and should also end in his favour. This is also quite normal desire of him. Court of any rank has to maintain equilibrium among them and has to strike balance. Courts are not vested with power of arbitrariness. The parties to proceedings and the general public should understand this aspect also. Courts are not only root of delay but there are so many factors which operate before a final verdict come before he parties or public.
It is not media investigation and justice, Rakhi Ka Insaf or Kiran Bedi’s Adalat or village Panchayat. It is also not a fact that delay occurs in judicial works also. Can any one cite an example that in administration there is never delay where the department it self has to take decision. Why retired persons should not get their pension right from the next month when pension becomes due? Why government employees have to approach courts for redress when big bureaucrats are sitting in Secretariats? It is the Baboo Dom that works there and here in judiciary the judge has to perform his work and it is not that a baboo who writes a note sheet and boss initials it. Let us know any department which is not suffering from delay syndrome? Like judiciary other departments have not to hear the parties to proceedings and advocates and to record evidence but the departments have to take decision alone even then delay is there. Therefore some device is to be introduced which can reduce the procedural delays and the cases in courts and in administration are disposed of efficiently. As to the role of investigating agencies. Clients, advocates and judges is concerned vies can be expressed some other time.
